The Recovery and Insolvency Specialists Association (Cayman) Limited (RISA) is committed to being a responsible custodian of the information you provide to us and the information we collect in providing our services to you and to our membership.
This privacy notice (Notice) sets out how RISA as a data controller may collect, use and share information in relation to the provision of our services.
Personal identification information
"Personal Information" is any information that can be used to identify you or that we can link to you as an individual.
RISA (we, us or our) may collect personal identification information from you in a variety of ways, including, but not limited to, when you visit our website at www.risa.ky (the Site), apply for membership, subscribe to our newsletter and in connection with other services, features or resources we make available to you.
The personal information we collect may include:
- Full name, date and place of birth and gender;
- Contact details including postal address, email address, telephone numbers;
- Educational background and experience;
- Company or organisation details;
- Credit card or other membership payment information;
- Information we collect automatically through cookies and similar tracking technologies through the Site;
- We may also collect information that you voluntarily provide to us, including when you communicate with us via email, on social media or other channels, when you register for our updates and when you respond to our communications or requests for information.
Non-personal identification information
We may collect non-personal identification information about you whenever you interact with the Site. Non-personal identification information may include the browser name and technical information about your means of connection to the Site, such as the operating system and your Internet Protocol address.

The Site may use "cookies" to enhance user experience. Your web browser places cookies on your hard drive for record-keeping purposes and sometimes to track information. You may choose to set your web browser to refuse cookies, or to alert you when cookies are being sent. If you do so, please note that some parts of the Site may not function properly.
How we protect your information
RISA collects and uses your personal information for the following purposes:
- To maintain our register of members;
- To manage our relationship with you, respond to your enquiries or to any problems that may arise;
- To send you marketing and educational communications, and other information or materials that may be of interest you or which you have expressed an interest in receiving (and subject to your ability to opt-out from receiving those communications);
- To register RISA members as members of the International Association of Restructuring, Insolvency and Bankruptcy Professionals (INSOL); and
- To improve our Site
Grounds for using your personal information
We rely on the following legal grounds to process your personal information, namely:
- Necessity for performance of a contract
- With your consent - We may use personal information as described in this Notice subject to your consent. To withdraw consent you can contact us via our Contact Us page.
- Legal obligation – We may process your personal information as may be required to comply with any legal or regulatory obligations that may apply to us.
- Legitimate interests – We may use your personal information for our legitimate interests to improve our services.
Retention of the information we collect
We retain the information we collect for no longer than is reasonably necessary to fulfil the purposes for which we collect the information and to comply with our legal obligations.
How we protect your information
We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of personal information and data stored on our Site. This includes, when required or appropriate and feasible, obtaining written assurances from third parties that may access your data that they will protect the data with safeguards designed to provide a level of protection equivalent to that adopted by us.
However, no information system can be 100% secure, so we cannot guarantee the absolute security of your information. Moreover, we are not responsible for the security of information you transmit to us over networks that we do not control, including the internet and wireless networks.
We may store the information we collect on our servers, both cloud based or in servers located in countries where we or our service providers have facilities. Therefore, we may transfer information to countries outside the Cayman Islands which may have different data protection laws and regulations.
Sharing your personal information
We do not sell, trade, or rent personal identification information to others. We may share generic aggregated demographic information not linked to any personal identification information for the purposes outlined above.
We may also disclose information we collect:
- With third party service providers that perform services on our behalf, such as web-hosting companies, analytics providers and information technology providers. In these circumstances contractual and other technical and security safeguards will be put in place to ensure that personal information is processed only in accordance with this Notice.
- To law enforcement, other government authorities, or third parties as may be permitted or required by the laws of any jurisdiction that may apply to us. In these circumstances, we will take reasonable efforts to notify you before we disclose information that may reasonably identify you unless prior notice is prohibited by applicable law or is not possible or reasonable in the circumstances.
- With the International Association of Restructuring, Insolvency and Bankruptcy Professionals (INSOL) for membership enrolment purposes. Please note that INSOL has a separate privacy notice for its members and the terms of that notice and the processing of personal information by INSOL may differ from those described in this Notice;
- Where necessary, with other members of RISA who serve on RISA membership committees and sub-committees;
Third party websites
You may find advertising or other content on our Site that links to the sites and services of third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Site. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Site, is subject to that website's own terms and policies.
Your choices and rights
Under local law, you have certain rights in relation to the personal information that we have collected. Residents of the Cayman Islands have the right to request (i) access to their personal information, (ii) rectification or erasure of personal information, (iii) restriction of processing concerning them, and (iv) objection to processing that is based upon our legitimate interests. Your ability to exercise these rights will depend on a number of factors and, in some instances, we will not be able to comply with a request, for example because we have legitimate grounds for not doing so or where the right doesn’t apply to the particular information we hold.

RISA has the discretion to update this privacy notice at any time. We encourage you to check this page on our Site for any changes.
Your acceptance of these terms
By using this Site, you signify your acceptance of this policy and terms of service. If you do not agree to this policy, please do not use our Site. Your continued use of the Site following the posting of changes to this policy will be deemed your acceptance of those changes.
